"marque première" is not a specialised trade mark term. In my view, "première" is simply being used here in the ordinary sense of the "former" or "first" to distinguish it from the "latter" or second". See these examples:

26 La requérante estime que les produits en conflit sont en partie identiques et en partie similaires. Les « préparations médicales et pharmaceutiques » couvertes par la marque ECHINAID seraient des produits identiques aux « produits chimiques pharmaceutiques » visés par la marque ECHINACIN, tandis que les « vitamines, compléments alimentaires, préparations à base de plantes » protégés par la première marque leur seraient semblables.
39 Enfin, la requérante invoque une décision de la quatrième chambre de recours du 18 juin 2003 (R 121/2002-4), dans laquelle cette dernière aurait conclu à l’existence d’un risque de confusion entre les marques SELENIUM-ACE et Selenium Spezial A-C-E. 26 The applicant points out that the products in dispute are in part identical and in part similar. ‘Pharmaceutical and medical preparations’ covered by the mark ECHINAID are products identical to ‘chemical pharmaceuticals’ referred to by the mark ECHINACIN, while ‘vitamins, food supplements, herbal preparations’ protected by the former mark are similar.
39 Finally, the applicant cites a decision of 18 June 2003 of the Fourth Board of Appeal (R 121/2002-4) in which it was concluded that there was a likelihood of confusion between the marks SELENIUMACE and Selenium Spezial A-C-E. According to that decision, the word ‘Selenium’, designating a chemical element, was not only part of the former mark but would be perceived by the average consumer as its most significant element and therefore had to be regarded as sufficiently distinctive. It followed that there was a likelihood of confusion.

The confusion arose from "les marques", whereas what was being referred to was a single word, and therefore a single component of the overall trade mark. "

Earlier brands

Whenever a patent has to be given, it is always checked thoroughly if it has been patented earlier from first or in this case earlier brands.
