相比其他两词,malesance则为“不当作为”,指行使了某人本完全不应当行使的行为(the doing of an act which one ought not to do at all)。

Misfeasance

n.

不当行为;失职行为。

指本可合法从事而不恰当地从事甚或侵犯他人权利的行为,特指公司管理上的失职行为。相关词 nonfeasance指应该作为而不作为,即懈怠,不履行义务;malfeasance指从事法律禁止的违法行为。

misfeasance应为“作为不当”,指不当履行某人本应合法行使的行为(the improper performance of some act which one may lawfully do),如在履行合同时犯有过失,其有主动不当行为导致他人损害的含义( active misconduct working positive injury to others)。



nonfeasance为“不当不作为”,指对某人本应履行的职责采取不作为的态度(the omission of an act which one ought to do),为消极不作为或未采取对他人的保护( passive inaction or a failure to take steps to protect others from harm)。


该词与“ misfeasance”及“malfeasance”两词的区别在于:misfeasance指以不适当的方式履行职责或义务,而 malfeasance指一个人做出其根本不应做的行为,即不法行为

所以徇私枉法都是MALFEASANCE;

玩忽职守程度重的可能是MALFEASANCE,轻的可能就是MISFEASANCE,具体界定可能要由司法界去完成了。

玩忽职守可能不以徇私为目的,而是因无能、不作为、疏忽、漠视等引起,因此属于MISFEASANCE的情况较多。

Summary:

malfeasance = intentional misconduct, for instance stealing, bribery & corruption, so *misconduct* in public office or when serving a company directorship.

Misfeasance proceedings can be brought by a company liquidator in England & Wales against well-intentioned, but mismanagement-prone co. directors (e.g. of a translation company) to make up and compensate the loss causes. (often referred to in other legal systems as 'an action to overcome the losses'.

Nonfeasance = an omission or failure to act and a tort / civil wrong verging on the criminal, such as a railway signals operator at a level crossing barrier falling asleep on the job, sending trains and/or cars crashing into each other.

The AmE definitions of mal- and mis-feasance many not exactly coincide with the UK and Aussie varieties.
