ما يثير التساؤل حقا هو كيف يستساغ عقلا أن يكون سند المدعى عليها الخامسة للزعم بسقوط الشيء وعكسه !!! إذ يستحيل بمكان العمل أن يجتمع التنازل عن الشيء وقيام المطالبة به في الوقت ذاته، فالمرء إما يتنازل عن الشيء أو أن يطالب به، ما يتضح معه للمحكمة الموقرة أن النعي يحمل معول هدمه.
