in der Leistungsklage ... verhandeln

I am having problems with understanding what exactly is meant by this sentence:

...die Rechtsauffassung, dass bei einer negativen Feststellungsklage dann das Rechtsschutzbedürfnis entfalle, wenn in der Leistungsklage, weil sie dann nicht mehr ohne Zustimmung des Schuldners zurückgenommen werden könne, verhandelt worden sei...

Can the phrase "in der Leistungsklage ... verhandeln" be translated as "hearing a case regarding an action for preformance"?

And to which action ("weil sie dann nicht mehr ohne Zustimmung des Schuldners zurückgenommen werden könne") does the second part of the sentence relate to - the Leistungsklage or the Feststellungsklage?

Can we please have a longer extract ... This snippet is insufficient to provide you with any real help. In addition, a bit more context of who is writing this and discussing someone else's "Rechtsauffassung" would be helpful.
