Quiere decir que para que los efectos protectores de la ley de marcas se activen, tiene que existir entre la marca opositora y la que se pretende registrar, suficientes puntos en común como para inducir a una posible confusióhn. Entonces la expresión que preguntas, la traduciría como sugiero más arriba.

OR:
"above-mentioned brand" or "referenced brand" instead of "aforementioned brand."
I think you need to change the word order in English to construct a sentence that makes sense.

In response to your comment, the phrase "al que pretende hacerlo valer" seems to refer to a person or entity of some kind. If not a person, then perhaps "party" would work in English....
OR:
"above-mentioned brand" or "referenced brand" instead of "aforementioned brand."
I think you need to change the word order in English to construct a sentence that makes sense.
