First one can also be turned round: 'determination of the case shall be predicated on the applicant's statement/ master's protest etc'.

Second one I almost missed: Eurospeak or lawspeak in pleadings or judgment for 'it is verily assumed that..'

whoops - Left at bit out - in the first one I would say \'will be noted\' or \'will be taken down\'. In the second one I would put \'it should be noted\'.
