Też wydaje mi się, że "kaucja" nie jest najlepszym wyborem, bo wiąże się z aspektem finansowym, który np. w prawie szkockim jest obecnie w ogóle nie stosowany. "Poręczenie" jest lepsze, bo np. występuje w polskich tłumaczeniach dokumentów unijnych jako ekwiwalent "bail" (np.: http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=COM:20... Z drugiej jednak strony wcale nie jest idealne, bo wg polskiego prawa poręczenie może być majątkowe bądź społeczne ( gdy poręcza zakład pracy lub szkoła). W szkockim prawie żadna z tych sytuacji nie zachodzi. Zwolnienia z aresztu przedprocesowego ("on bail") dokonuje się pod pewnymi warunkami (standardowymi, takimi jak pozostawanie w danym miejscu zamieszkania), bądź specjalnymi (takimi jak zakaz przebywania badź znajdowania się w pobliżu pewnych miejsc lub kontaktowania się z określonymi osobami). Dlatego też ja tłumaczę to jako "warunkowe zwolnienie z aresztu".
