I'm wondering if "misma" refers to "adquisición" or "cláusula" here and what would be the best translation of "procede".

Any suggestions would be most welcome.

"...solicito a XXX muy respetuosamente modifical el contrato de compraventa YYY cuyo objeto es "adquisición de sistemas para el fortalecimiento tecnológico de la plataforma ZZZ en la cláusual cuarta FORMA DE PAGO, **en el sentido de indicar que la misma procede** con la entrega de los equipos establecidos para la vigencia 2013."

My guess would be that it refers to "forma", and means that payment is due when the equipment is delivered. But I agree that it's not written clearly.

my interpretation I read this as:
I would like X to please amend Clause 4 "Payment" of the contract to state that [la misma] should supply the equipment chosen for the 2013 period".

I suspect "la misma" may be referring to "plataforma Z", and my translation of the last phrase is iffy as I lack the context to know what "vigencia 2013" is. HTH.

it of course being payment. Ruth, proceder rarely means proceed in a legal context.

Ruth I think it's sloppy drafting but I'm pretty sure that this is what it means.

It's interesting that they say "misma" though. You would have thought it would be "mismo" if referring to the payment, but maybe it's referring to the whole thing, ie "forma de pago".

Pretty sure “la misma” refers back to “la cláusula cuarta”. Here’s my general understanding of the passage:


"...solicito a XXX muy respetuosamente modificar el contrato de compraventa YYY cuyo objeto es "adquisición de sistemas para el fortalecimiento tecnológico de la plataforma ZZZ en la cláusula cuarta FORMA DE PAGO, en el sentido de indicar que la misma procede con la entrega de los equipos establecidos para la vigencia 2013."


“…kindly request XXX to amend the YYY Purchase Agreement, the purpose of which is "the acquisition of systems to upgrade the technology of the ZZZ platform set out in Clause Four: PAYMENT METHOD, so that it indicates/includes the delivery of the equipment agreed for 2013.”

As I understand it, "en el sentido de indicar que la misma procede con" literally means "in the sense of indicating that the same [clause 4] comes with", which is all rather redundant in my view.
