Exceptional leave to remain for continuing employment

A permissive waiver - not necessarily to work in a Red-Light District, though the asker does not give any context and Ladies of the Night have been known to sue the EU - and forbearance, all rolled into one.

Thanks, Chris. All I did was piggy-back a previous ProZ answer to Duldung and add my favourite label of continuing vs. continued for the employment.

Tolerated Stay for Working Professionals

Since January 1, 2020, there is a new type of "Duldung" or tolerated stay permit: the so-called "Beschäftigungsduldung", which is regulated in §60d Residence Act. "Beschäftigungsduldung" is issued for those with a "Duldung" who already have a job and meet other requirements. Tolerated Stay for Working Professionals or "Beschäftigungsduldung" has two significant advantages over regular "Duldung": 1) As long as you have a "Beschäftigungsduldung", you cannot be deported. 2) As a holder of a "Beschäftigungsduldung", you can obtain a residence permit more quickly.

Nochmals vielen Dank - gerade Tonys oder Susans Abwandlung wäre mit Sicherheit auch eine gute Möglichkeit gewesen, doch für meine Zwecke war Adrians Variante besser.

neutral AllegroTrans : Whilst I realise "Tolerated Stay for Working Professionals" is a sort of unofficial translation on a couple of German websites, it sounds like clumsy English to me; there must be a better way of expressing this; ayou can't call all workers "professionals"

agree TonyTK : You see "tolerated stay permit" a lot for "Duldung", and I agree with the asker that "professional" doesn't really work; perhaps "tolerated stay permit for employment purposes" (as it could be any old job).

agree Susan Starling : Agree with "tolerated stay" which seems to be common in the EU vs "exceptional leave to remain" which appears to be strictly UK usage. Perhaps "tolerated stay for work purposes" - unless this applies only to employees and not to freelancers.

Einführung
Ende 2018 hatten über 180.000 Menschen in Deutschland
eine sogenannte „Duldung“. Eine Duldung bedeutet, dass die
Abschiebung vorübergehend ausgesetzt ist. Ein solcher Status
ist in der Regel mit vielen Unsicherheiten und Einschränkun-
gen verbunden. Es gibt einige Wege, von der Duldung in einen
festen Aufenthalt zu kommen. Dazu zählen die sogenannten
„Bleiberechtsregelungen“ nach §§ 25a und 25b AufenthG, der
Härtefallantrag (§ 23a AufenthG) sowie die Ausbildungsdul-
dung (§ 60c AufenthG).
Seit dem 1. Januar 2020 gibt es eine weitere Bleibeperspek-
tive für Personen mit „Duldung“, die schon seit längerem in
Deutschland arbeiten und einige weitere Voraussetzungen
erfüllen: die sogenannte „Beschäftigungsduldung“ (§ 60d Auf-
enthG).
Diese Broschüre erklärt, was die Beschäftigungsduldung ist,
welche Voraussetzungen erfüllt sein müssen, damit sie erteilt
werden kann, und wie die zu einer
Aufenthaltserlaubnis führt.
Für eine Erstberatung können Sie sich an den Flüchtlingsrat
Baden-Württemberg wenden. Dieser vermittelt dann ggf. zur
weitergehenden Beratung und Begleitung an eine Beratungs-
stelle bei Ihnen vor Ort
