svědek nebyl nikdy vyslechnut kontradiktorně, což je jedním z minimálních práv, která má každý, kdo je obviněn z trestného činu (srov. čl. 6 odst. 3 písm. d) Úmluvy o ochraně lidských práv a základních svobod).
Dobrý den, hledám anglický ekvivalent výrazu "kontradiktorní výslech" ve výše uvedeném kontextu.
Prozatím mám tyto možnosti: adversary/adversarial examination...inter partes examination.
Pořád se mi nedaří dohledat, jestli by staré známé "cross-examination" bylo ono...

"Kontradiktornost, slovo pocházející z latiny (contra dicere = mluvit proti, oponovat) v obecné rovině znamená vyjevováních sporných skutečností cestou polemiky, sporu. Vše v občanském procesním právu musí být podrobeno debatě účastníků, kteří mají právo vyjádřit se ke všem skutečnostem a ke všem důkazům, to se týká i nesporného řízení. Jako jeden ze základních právních principů je třeba připustit kontradiktornost v každém řízení, bez ohledu na jeho povahu."

The right to confront witnesses: Article 6(3)(d)
The wording and the case-law of Article 6(3)(d) support the principle of
equality of arms which underlies Article 6 in its entirety. For example, in the
case of Bönisch v. Austria (1985), the Court held that a trial court must follow
that same pattern of interrogation in examining its own expert witnesses and
those called by the defence. The right to call or confront witnesses is not an
unlimited right. Courts may determine the number of witnesses a party may
call or the necessity of hearing a particular witness in order to establish the
facts of the case or otherwise contribute to a fair adjudication (Perna v. Italy
(2003) (no violation of Article 6(1) and 6(3)(d) for not calling a witness whose
testimony would consist of a denial of allegations against him)). However, in
the event that a court refuses to admit evidence proposed by a party, it must
provide reasons for the refusal (Pisano v. Italy (2000) and Suominen v.
Finland (2003)).

Each party may also question the other’s witness(es).
When you ask questions of the other party’s witness(es), it is called a "cross-examination".
A litigant (or their lawyer) is allowed considerably more latitude in cross-examination then when you question your own witnesses (called an "examination-in-chief").
For example, you are not allowed to ask leading questions to your own witness whereas you can in cross-examination.
