I'm stuck for an apt turn of phrase for "aufheben" which would work in such an abstract context.
Context: ethical guidelines put forward by Vitoria [1483-1546] for the conversion of the native Americans.
"Missionierung sei nur in der Form der freien Verkündung, nicht des Zwanges erlaubt. [[Conversion was only permissible in the form of persuasion, not compulsion. ]] ***Unglaube aber hebe weder das natürliche noch das menschliche Recht auf. *** Die Indianer seien sowohl kraft ihres eigenen Rechts als auch kraft des universalen Naturrechts als Eigentümer und freie Vertragspartner zu achten." [[The Indians were to be respected as property owners and legal subjects both by virtue of their own laws and by virtue of universal natural law.]]
