3.1 Νόμος 2289/1995
Ο νόμος 2289/1995 ψηφίστηκε τον Φεβρουάριο του 1995 και περιλαμβάνει άρθρα που αφορούν τα δικαιώματα του δημοσίου όσον αφορά την έρευνα, αναζήτηση και εκμετάλλευση των υδρογονανθράκων, τη συμμετοχή του δημοσίου στις παραπάνω διαδικασίες, περιγραφές που αφορούν την ιδιότητα των αναδόχων και τις υποχρεώσεις του. Επίσης περιλαμβάνει αναλυτικές πληροφορίες περί εκτέλεσης των εργασιών του έργου, τα δικαιώματα του δημοσίου όσον αφορά την αγορά των κοιτασμάτων ή των προϊόντων τους, την φορολογία που υποχρεούται να καταβάλει ο ανάδοχος φορέας και τη λήξη των εργασιών ή και αναστολή τους. Τέλος σημαντικό είναι το γεγονός πως ο παρών νόμος περιλαμβάνει και τροποποιήσεις διατάξεων παλαιότερων νόμων όπως του νόμου 336/1976 (ΦΕΚ 27, 1995).
Πιο αναλυτικά ο νόμος αυτός αποτελείται από τέσσερα ξεχωριστά κεφάλαια. Το πρώτο κεφάλαιο φέρει τον τίτλο Άσκηση των ‘’Δικαιωμάτων του Δημοσίου’’ και αποτελείται από τέσσερα συνολικά άρθρα. Το πρώτο άρθρο έχει ως περιεχόμενο την επεξήγηση όλων των ορισμών που είναι απαραίτητο να κατανοηθούν όχι μόνο για την κατανόηση του νόμου αλλά και για την σωστή διεκπεραίωση τυχόν έργων αναζήτησης και εκμετάλλευσης υδρογονανθράκων. Ενδεικτικά στο άρθρο ένα του νόμου 2289/1995 περιλαμβάνονται ορισμοί που αφορούν την νομική έννοια των λέξεων Υδρογονάνθρακες, Παραπροϊόντα, Αναζήτηση και Εκμετάλλευση Υδρογονανθράκων, Εκμισθωτής, εργοδότης, Ανάδοχος, Συγγενής επιχείρηση και Ανεξάρτητος τρίτος.
Το δεύτερο άρθρο του πρώτου κεφαλαίου του νόμου 2289/1995 περιλαμβάνει το νομικό πλαίσιο που αφορά τα δικαιώματα του δημοσίου στους υδρογονάνθρακες, την έρευνα, αναζήτηση και εκμετάλλευση αυτών, τους τρόπους παραχώρησης των δικαιωμάτων που αφορούν την εκμετάλλευση υδρογονανθράκων και προϊόντων αυτών κι λεπτομέρειες περί έρευνας και εκμετάλλευσης μέσω σύμβασης μίσθωσης και σύμβασης διανομής της παραγωγής ( ΕΛΥΝΙΑΕ, xx).

3. Relevant Legislation
3.1 Law No 2289/1995
Law No 2289/1995, which was passed in February 1995, contains articles concerning the State’s rights with respect to hydrocarbon prospection, exploration, and exploitation, the State’s participation in the above processes, and descriptions of the concessionaire’s qualifications and responsibilities. Additionally, the law provides detailed information regarding carrying out work under the operation, the State’s rights with respect to the sale of reserves or their derived products, the taxes that the concessionaire is required to pay, and the termination of the work or its suspension. Finally, it should be noted that the present law includes amendments to provisions of older laws, such as Law No 336/1976 (Greek Government Gazette 27, 1995).
Examined in more detail, the present law comprises four distinct chapters. The first chapter, entitled “Exercise of the Rights of the State,” consists of four articles in total. The first article provides a clarification of the definitions that are necessary not only to understand the law but also to properly conduct an operation for prospecting and exploitation of hydrocarbons. For example, Article 1 of Law No 2289/1995 defines the legal concepts of Hydrocarbons, By-products, Exploration and Exploitation of Hydrocarbons, Lessor, Employer, Concessionaire, Associated undertaking, and Independent third party.
The second article of the first chapter of Law No 2289/1995 sets out the legal framework as it relates to the State’s rights regarding hydrocarbons and the prospecting, exploration, and exploitation of them, the methods for granting rights for the exploitation of hydrocarbons and hydrocarbon products, and details regarding exploration and exploitation under a lease contract or a production sharing contract (ELINYAE - Elliniko Institouto Ygieinis & Asfaleias tis Ergasias, Hellenic Institute for Occupational Health and Safety, xx).
