Using mortgage here is most likely too specific. According to Marcílio Moreira de Castro, gravar = encumber and ônus real is one of several synonyms for the more generic security interest, which is just the broadest way of describing an encumbrance. A hipoteca (mortgage) is a type of security interest, but not all security interests are mortgages.

I found a very similar sentence below in a book about the American legal system, which gives an idea how this can be used in context.
