The claim stated in the writ of summon is regarding a damage compensation based on the very same events already discussed during the injunction procedure under article 700 of civil procedure code (and during the subsequent appeal).

Source text - Italian ART. 4 – OBBLIGHI DEL CONCEDENTE
4.1 Il Concedente si impegna a fornire i Prodotti al Concessionario per tutta la durata del contratto con continuità.
4.2 Il Concedente si riserva la facoltà di variare le tipologie dei Prodotti individuati nel presente Contratto ( o nell’allegato A al presente contratto) dandone tempestiva comunicazione al Concessionario.
4.3 Il Concedente si impegna a fornire i Prodotti al Concessionario alle condizioni e modalità descritte nel successivo art. 9 e a realizzare il massimo sforzo, compatibilmente con la propria capacità produttiva e con le proprie esigenze organizzative, per accettare tutti gli ordini che gli saranno trasmessi dal Concessionario.
4.4 Il Concedente si impegna a fornire al Concessionario, su richiesta di quest’ultimo, tutte le informazioni commerciali ritenute utili o necessarie per la commercializzazione dei Prodotti.

4.2 The Selling Party has the right to modify the kind of Products indicated in this agreement (or in appendix A of present agreement) by giving prompt communication to the Distributor.
4.3 The Selling Party shall supply to the Distributor the Products according to the conditions and having the characteristics described in the following art. 9 and shall – with its maximum effort, compatible with its own productive capacity and organizational needs – accept all the orders that will be placed by the Distributor.
4.4 The Selling Party shall provide the Distributor, on request of this latter, with all the commercial information which are considered useful or necessary for the commercialization of the Products.
4.5 The Selling Party shall provide the Distributor with consulting as regards the image and personalization of the sale points and of advertising campaigns that are considered opportune for the development of the commercialization of the Products in the Territory. 15 This Agreement may be terminated forthwith by either party hereto upon:
15.1 The other party's failure to comply with any of the terms or conditions or provisions hereof and the continuation of such default for a period of thirty (30) days after written notice thereof is sent to such defaulting Party or, if such default cannot reasonably be cured within such thirty day period, within such additional time as may be necessary for the defaulting Party acting in good faith and with diligence to cure such default;
15.2 A petition of bankruptcy, arrangement or reorganization being filed, or if a similar proceeding is commenced, whether voluntary or involuntary, by or against the other Party hereto, or if such other party shall make any assignment for the benefit of creditors, or if receiver or trustee of such other Party's property is appointed by a court of competent jurisdiction.
